About these terms
These terms are an agreement between Solvara Technologies & Softwares (OPC) Pvt Ltd (“we”, “us”), which provides Polar Integrity (the “Service”), and the organization that creates an account (the “Customer”, “you”).
By creating an account or using the Service you accept these terms on behalf of your organization, and confirm you have authority to do so. A separate written agreement signed with us, if any, takes precedence where it differs.
02
The Service
Polar Integrity checks remote interviews for hidden assistance: it runs a device check on the candidate’s computer through Polar Check, analyses the interview call audio, and gives you a report.
- Reports are evidence for human review. They do not rank candidates or recommend a hiring outcome, and you remain responsible for every hiring decision.
- No detection method is complete. A report without findings does not prove an interview was free of assistance, and a finding can have an innocent explanation.
- We improve the Service over time and may change features, provided the core service you paid for is not materially reduced.
03
Accounts
- The Service is for businesses. Accounts are opened with a work email address at your organization’s domain.
- Admins in your organization control who has access and what they can see. You are responsible for activity under your organization’s accounts.
- Tell us promptly at [email protected] if you suspect unauthorized access.
04
Your responsibilities
- Have a lawful basis for screening candidates with the Service, and use it only for genuine interviews.
- Inform your interviewers, including interviewers who are not your employees, such as agency or client panelists, that interviews are captured as described below.
- Use reports fairly: do not use them to discriminate on any ground protected by law, and give candidates a chance to respond before acting on a finding where the law or fairness requires it.
- Give us accurate interview and candidate details, and only the personal data the Service needs.
05
Interview audio
When a candidate runs Polar Check, the Service captures the audio of the interview call on the candidate’s computer: the candidate’s microphone and the sound the meeting application plays, which includes your interviewers and any other participants. Capture runs for the whole call, including while the candidate is muted, and starts only after the candidate has agreed to it. Audio is analysed as it arrives to produce the interview report. The full call is not stored: only short evidence clips around a signal are retained, for the period set in your settings (30 days by default).
06
Acceptable use
You must not, and must not let others:
- copy, modify, reverse engineer or decompile the Service or Polar Check, except where the law allows it despite this restriction;
- try to bypass its checks, security or usage limits, or probe it for vulnerabilities without our written permission (report vulnerabilities to [email protected]);
- use it for surveillance outside an interview, or in breach of any law;
- resell it or use it to build a competing product.
We may suspend access that breaches these terms or puts the Service or others at risk, and will tell you why unless the law prevents it.
07
Credits, prices and payment
- The Service is paid for with prepaid interview credits. One credit is used when the report for an interview is generated; interviews that never produce a report use none.
- New organizations receive a free trial of 3 credits, once per organization.
- Credits are valid for 12 months from purchase. Unused credits expire after that.
- Prices are shown before you pay, in the currency for your billing country. Payments are processed by Razorpay. Taxes, where they apply, are shown on the invoice.
- Every purchase has a numbered invoice, available to your organization’s admins.
- We may change prices for future purchases. Credits you have already bought are not affected.
08
Refunds
Unused credits can be refunded within 14 days of purchase, as set out in our refund policy.
09
Data protection
We process candidate and interviewer data on your behalf and only on your instructions, as described in our privacy policy and on our compliance page. A data processing agreement is available on request. Each party complies with the data protection laws that apply to it.
10
Ownership
You own your data and the reports produced for you. We own the Service, Polar Check, our detection methods and everything we build, and grant you a non-exclusive, non-transferable right to use the Service under these terms while your account is active. If you send us feedback, we may use it without obligation to you.
11
Confidentiality
Each party keeps the other’s non-public information confidential, uses it only for the purposes of these terms, and shares it only with people who need it and are bound to the same duty. This does not cover information that is public, already known, independently developed or required to be disclosed by law.
12
Availability
We work to keep the Service available and to give notice of planned maintenance. The Service depends on candidates’ devices, networks and meeting applications, which we do not control; an interview that cannot be checked is reported as such.
13
Warranties and liability
The Service is provided “as is”. To the extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose and that the Service will detect every form of assistance.
To the extent the law allows, neither party is liable for indirect or consequential loss, or for loss of profits, revenue or goodwill, and our total liability under these terms is limited to the amount you paid us in the 12 months before the claim arose. Nothing here limits liability that cannot be limited by law.
14
Ending the agreement
You can stop using the Service and ask us to close your organization’s account at any time. We may end these terms on 30 days’ notice, or at once for a serious breach. When the account closes, data is deleted under our retention schedule, and remaining credits are refunded only as our refund policy provides.
15
Changes to these terms
We may update these terms. For material changes we email your organization’s admins at least 30 days before they take effect. Continuing to use the Service after that date means you accept the new terms.
16
Governing law
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them.
